The Law Offices of Attorney Eric Feinberg offers tenant defense in the New York City area.
There are two type of proceedings normally brought in the NYC landlord-tenant court (aka The New York City Housing Court). The first and the majority of cases involve non–payment of rent, the landlord is suing tenant because they owed rental arrears or back rent. This is known as a Non-Payment Proceeding.
The other type of case is called a Holdover Proceeding. In this proceeding the landlord is simply trying to evict the tenant, unrelated, to whether the tenant owes money. There are a variety of reasons why, including:
- HP Action – Violations of legal housing standards, including repairs or lack of heat and hot water
- Major Capital Improvement (MCI) Rent Increases
- Succession, Succession Rights and Succession Claims
- Tenant Harassment
- Breach of Lease Holdovers
- Evictions Based on Pets
- Warrant of Habitability
- Non-primary Residency
- Landlord Access
- DHCR Admin Procedures
